Availability of Products
Products typically ship within 24/48 hours. Due to increased volume shipping rates, options and times will vary. Inventory on www.cognituv.com will typically remain current. For orders placed we have systems in place to keep you up to speed with your order’s details.
All prices are in U.S. Dollars. No tax, shipping, or handling is included in promoted prices unless explicitly stated.
For Orders under $10,000 USD, all monies owed for orders under $10,000 are invoiced at net 5 days from the time of purchase.
Orders over $10,000 USD will require a 50% payment of monies owed invoiced at net 15 days from the time of purchase. The remaining 50% owed is invoiced upon delivery of the order and will be at net 15 days from the time of delivery.
Orders exceeding $50,000 USD will require a 50% payment of monies owed invoiced at net 15 days from the time of purchase. Additionally, we may require at the time of purchase the remaining 50% of the order value to be escrowed by a third party and be released upon delivery.
LIMITED WARRANTY ON COGNITUV DEVICES
This limited warranty gives you specific legal rights and you may also have other rights, which vary from state to state.
The limited warranty can also be found online at https://www.cognituv.com/warranty-rma and in the documentation, we provide with the product.
We warrant that during the warranty period, the product will be free from defects in materials and workmanship.
We limit the duration and remedies of all implied warranties to the duration of this express limited warranty. We expressly exclude any implied warranty of specified or particular purpose.
Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
Our responsibility for defective goods is limited to repair or replacement as described below in this warranty statement.
Who may use this warranty?
Cognituv located at address 5004 Bee Creek Road, Suite 320, Spicewood, TX, USA (“we“) extend this limited warranty only to the customer who originally purchased the product (“you“). It does not extend to any subsequent owner or other transferees of the product.
What does this warranty cover?
This limited warranty covers defects in materials and workmanship of the Cognituv product (the “product“) for the Warranty Period as defined below.
What does this warranty not cover?
This limited warranty shall only apply if the product has been installed and operated (i) in compliance with the specifications and guidelines set forth herein, on the product label and packaging, and on the Cognituv website, (ii) in accordance with the associated safety standards, the National Electric Code (NEC), the Standards for the American National Standards Association (ANSI), or in Canada, with the standards of the Canadian Standards Association (CSA), and (iii) in equipment designed and approved for the application and in environmental conditions within the normal specified operating range of the product.
This limited warranty does not apply to loss or damage to the product caused by negligence; abuse; misuse; mishandling; improper installation, storage, or maintenance; damage due to fire or acts of God; vandalism; civil disturbances; power surges; improper power supply; electrical current fluctuations; corrosive environment installations; induced vibration; harmonic oscillation, alteration; accident; failure to follow installation, operating, maintenance or environmental instructions or other actions or events beyond our reasonable control.
This limited warranty excludes labor and equipment required to remove and reinstall original or replacement parts.
This limited warranty is void if the product is not used for the purpose for which the product is designed.
What is the period of coverage?
This limited warranty starts on the date of your purchase and lasts for two years for the device and one year for the lamp (the “Warranty Period“). The Warranty Period is not extended if we repair or replace the product. We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.
What are your remedies under this warranty?
With respect to any defective product during the Warranty Period, we will, in our sole discretion repair or replace such product (or the defective part) free of charge. We will also pay shipping and handling fees to return the repaired or replacement product to you.
How do you obtain warranty service?
To obtain warranty service, you must [call [1-888-580-8738] or email our Customer Service Department at [email@example.com] during the Warranty Period to obtain a Return Merchandise Authorization (“RMA”) number. No warranty service will be provided without an RMA number]/[DESCRIPTION OF STEP-BY-STEP PROCEDURE FOR REQUESTING WARRANTY SERVICE WILL BE EMAILED].
Limitation of liability
The remedies described above are your sole and exclusive remedies and our entire liability for any breach of this limited warranty. Our liability shall under no circumstances exceed the actual amount paid by you for the defective product, nor shall we under any circumstances be liable for any consequential, incidental, special or punitive damages or losses, whether direct or indirect.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
All returns and order cancelations are subject to a 25% restocking fee.
In order to process a return, a customer must carry out the return procedure following the RMA model (Return Authorization Form).
